Kidzmat Limited Warranty and Limitation of Liability

LIMITED WARRANTY: KidzMat Global Enterprises, LLC ("KGE"), will repair or replace, at its discretion, any damaged KidzMat® that has failed as a result of a manufacturer’s defect, for one (1) year from date of original purchase. This limited warranty is valid only with proof of purchase showing purchase date, if not purchased online. KGE does not warrant the KidzMat® if it has been subjected to misuse, accident, improper maintenance, alterations, modifications, replacements and/or improper actions. KGE makes no further REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER CONCERNING THE KIDZMAT®, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE THE WARRANTIES STATED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES WHETHER ORAL, WRITTEN, IMPLIED, EXPRESSED, STATUTORY, OR ARISING BY LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

LIMITATION OF REMEDIES AND LIABILITY: KGE and Buyer agree that Buyer's sole and exclusive remedy against KGE shall be for the replacement or repair, at KGE's discretion, of any KidzMat® that has failed as a result of manufacturer’s defect. IT IS UNDERSTOOD AND AGREED THAT KGE'S LIABILITY WHETHER IN CONTRACT OR IN TORT, IN NEGLIGENCE OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT OF THE PURCHASE PRICE PAID BY BUYER FOR ANY KIDZMAT® AND UNDER NO CIRCUMSTANCES SHALL KGE BE LIABLE FOR SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THE PRICE PAID BY BUYER FOR THE KIDZMAT® IS A CONSIDERATION IN LIMITING KGE'S LIABILITY.

Any dispute, controversy, cause of action and/or claim arising out of or related to this Limited Warranty, the KidzMat® product, and/or the invoice evidencing purchase of the KidzMat® product shall be governed by the laws of the State of Texas applicable to contracts formed and performed wholly within such State, without giving effect to the conflicts of law provisions thereof. You consent and agree that all suits arising from or related to this Limited Warranty, the KidzMat® product, and/or the invoice evidencing purchase of the KidzMat® product shall be filed in the appropriate court in Dallas County, Texas. If KGE prevails in any claim, action, or proceeding arising out of or relating to this Limited Warranty, the KidzMat® product, and/or the invoice evidencing purchase of the KidzMat® product, or any appeal thereof, then KGE shall be entitled to its costs and expenses, including, but not limited to, reasonable attorneys' fees.

WARNINGS AND GUIDELINES: Please read carefully and follow these guidelines. Also, read the WARNING section of the instruction booklet that comes with your KidzMat® product. If any of these are not followed/violated, your limited warranty will be null and void

WARNINGS:

THIS IS NOT A TOY

Never allow children to “play” with the mat unsupervised

Do not leave exposed to sun or high temperatures for prolonged periods of time and never use around an open flame.

Do not attempt to store too many items or heavy items in mesh pockets.

Never store the mat while damp or dirty

Never abuse or misuse your mat, walk on mat with metal cleats, or use other sharp objects around the mat.

Do not attempt to clean your mat with harsh chemicals or abrasives. Water or ammonia based glass cleaner works best as a surface cleaner.

Failure to completely follow these guidelines and WARNING label could damage your KidzMat® and cause personal injury.
